• Registration details you provide need to be accurate and kept current
• Each Shopify store gets one account
• An active Shopify store is required to use the Service

3.2 Keeping It Secure

• You’re responsible for everything that happens under your account
• Tell us right away if you suspect unauthorized access
• We aren’t liable for loss or damage resulting from unauthorized use of your account

4.1 What’s Allowed

• Building mobile apps for genuine business purposes
• Customizing branding and content you have the rights to use
• Connecting and syncing your Shopify store data
• Reaching out for support and using our documentation

4.2 What’s Not Allowed

• Breaking any applicable law or regulation
• Infringing on someone else’s intellectual property
• Building apps containing illegal, harmful, or offensive material
• Trying to gain unauthorized access to our systems
• Using the Service for fraud or deception of any kind
• Reverse engineering, decompiling, or disassembling our software
• Reselling or redistributing the Service without our permission

5.1 Plans

• Several subscription tiers are available, each with its own features and limits
• Fees are billed upfront, either monthly or annually
• Fees aren’t refundable except where the law requires it

5.2 How Payments Work

• Payments are processed securely through Shopify’s billing system
• By subscribing, you authorize automatic renewal charges
• A failed payment can result in immediate suspension of service

5.3 Price Adjustments

• We may adjust subscription pricing with 30 days’ advance notice
• Current subscribers will be informed before any new pricing takes effect

5.4 Free Trials

• Trial terms, when offered, are shown at signup
• Unless cancelled, a trial converts automatically into a paid subscription
• A credit card is required to activate a trial

6.1 What’s Ours

• Victa - Mobile App Builder and its underlying technology belong to us
• Copying, modifying, or distributing our software without permission isn’t permitted
• All associated trademarks, logos, and service marks remain our property

6.2 What’s Yours

• You keep ownership of your store data, images, and content
• You grant us a license to use that content solely to deliver the Service
• You’re responsible for making sure you have the rights to anything you upload

6.3 The Apps You Build

• Apps generated through Victa belong to you
• Meeting app store requirements is your responsibility
• We can’t guarantee app store approval

7.1 DPDP Act, 2023 Compliance

As a Data Fiduciary under India’s Digital Personal Data Protection Act, 2023, we:

• Collect valid, informed, specific consent before processing personal data
• Process data only for clearly defined, lawful purposes
• Apply suitable technical and organizational security safeguards
• Report data breaches to the Data Protection Board of India and affected users within the required timeframes
• Support data principals in exercising their rights to access, correct, and erase their data

7.2 How Data Is Collected and Used

• Details on what we collect and how live in our Privacy Policy - please refer to that page
• Your Shopify store data stays your property
• We may use aggregated, anonymized data to improve the Service
• We do not sell personal data to third parties

7.3 Ownership and Rights Over Your Data

• You retain ownership of your store data, content, and customer information
• You grant us a limited license to process that data in order to deliver the Service
• You’re responsible for ensuring you hold the rights to anything uploaded
• Data principals retain rights to access, correct, and erase their personal data

8.1 Availability

• We aim for strong uptime but can’t promise a guaranteed 99% figure
• Scheduled maintenance will be announced in advance where possible
• We’re not responsible for interruptions caused by factors outside our control

8.2 Support

• Support is available at hello@victalabs.com
• Response times vary depending on your subscription plan, as outlined on the pricing page
• Support for free-tier accounts may be more limited

9.1 No Warranties

• The Service is provided “as is,” with no warranties of any kind
• We disclaim all warranties, whether express or implied, including merchantability and fitness for a particular purpose

9.2 Capped Damages

• Our total liability won’t exceed what you paid for the Service in the 12 months before a claim arises
• We’re not liable for indirect, incidental, or consequential damages
• Some regions don’t allow liability limitations like these, so they may not apply to you

9.3 App Store Approval

• We can’t guarantee approval by the Apple App Store or Google Play
• Meeting each store’s guidelines is solely your responsibility
• Rejection or removal from an app store doesn’t entitle you to a refund

11.1 If You Cancel

• You can cancel your subscription whenever you like
• Cancellation takes effect at the end of your current billing cycle
• You may delete your account and data at any time
• Partial months or unused time aren’t refunded

11.2 If We Cancel

We may suspend or terminate your account immediately if you:

• Breach these Terms or our Acceptable Use Policy
• Fail to pay subscription fees
• Engage in fraudulent or unlawful activity
• Cause harm to our systems or other users
• Violate applicable law, including the DPDP Act, 2023

11.3 What Happens After

• Your access to the Service ends immediately upon termination
• Your account data may be deleted after a reasonable holding period
• Provisions meant to outlive termination will continue to apply
• Any payments owed before termination remain your responsibility

13.1 How Changes Happen

• We may update these Terms at any time
• Material changes are communicated by email at least 30 days before they take effect
• Continuing to use the Service after that point counts as acceptance
• Minor, non-material changes apply as soon as they’re posted

13.2 How You’ll Know

• We’ll let you know about changes by email or within the Service itself
• It’s on you to review updated Terms when notified
• If you don’t agree with a change, you’ll need to stop using the Service

14.1 Which Laws Apply

• These Terms are governed by the laws of India
• Disputes fall under the jurisdiction of Indian courts

14.2 Resolving Disputes

• We’d rather resolve issues through direct conversation first
• For formal disputes, we favor binding arbitration over going to court
• You can opt out of arbitration within 30 days of creating your account

15.1 The Full Agreement

• These Terms, together with our Privacy Policy, make up the complete agreement between us and supersede any earlier understandings.

15.2 Severability

If any single provision here turns out to be unenforceable, the rest of the Terms remain valid and in effect.

15.3 No Waiver

If we don’t enforce a provision at some point, that doesn’t mean we’ve given up the right to enforce it later.

15.4 Assignment

• You can’t transfer your rights under these Terms to someone else without our agreement. We, however, may assign our rights and obligations to a third party.

15.5 Language

These Terms are written in English. Any translated versions are for convenience only - the English text governs if there’s ever a conflict.
